1. Introduction

Welcome to CoatingsAcademy.ca, an online learning platform operated by the Canadian Coatings Association (“CCA”, “we”, “us”, “our”). These Terms of Use (“Terms”) govern your use of the CoatingsAcademy.ca website, online courses, learning tools, and all associated digital services (collectively, the “Site”).

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with all applicable Academic Policies, including our Privacy Policy, Accessibility Statement, and other guidelines referenced herein.

We may update these Terms from time to time. Any updates will be effective immediately upon posting. Continued use of the Site after changes indicates your acceptance of the updated Terms.

 

2. Account Registration

You may browse certain areas of CoatingsAcademy.ca without creating an account. However, registration is required to:

Violation of the Code of Conduct may result in account termination, removal from courses, or legal action.

 

4. Ownership of Content & License to Use the Site

All content accessible on CoatingsAcademy.ca — including course materials, videos, text, graphics, assessments, data, software, and platform design — is owned or licensed by the Canadian Coatings Association (CCA) and protected by copyright, trademark, and other intellectual property laws.

  • You are granted a limited, non‑exclusive, non‑transferable license to:
  • Access course content for personal, non‑commercial learning
  • View, download, or print course materials where explicitly permitted

You may NOT:

  • Copy, modify, distribute, or create derivative works of course content
  • Share login access with others
  • Reproduce or redistribute learning content outside the platform
  • Use automated tools to extract, scrape, or index content
  • Reverse engineer or attempt to access source code
  • Remove copyright or proprietary notices

Any unauthorized use immediately terminates your license to use the Site.

 

5. Course Enrollment, Payments & Refunds

Enrollment in paid courses or programs may require payment at the time of registration. By making a purchase, you agree:

  • To provide valid payment information
  • That charges shown at checkout will apply
  • That taxes may apply depending on your location
  • To follow any course‑specific refund or withdrawal policies

We may cancel or suspend access if we cannot verify payment details or suspect fraudulent activity. Refund eligibility varies by course type. Course‑specific refund policies will be displayed at checkout or within course descriptions.

 

6. Links to Third‑Party Services

CoatingsAcademy.ca may include links or integrations with third‑party services (e.g., payment processors, video hosts, external resources). CCA is not responsible for the content, privacy practices, accessibility, or security of third‑party sites. Accessing them is at your own risk.

 

7. International Access

CoatingsAcademy.ca is primarily intended for users in Canada, the United States, and the European Union. Users accessing the Site from other regions do so voluntarily and are responsible for compliance with local laws.

We may restrict access to certain geographic regions as needed.

 

8. Violation of Terms

CCA may investigate violations and take any necessary action, including:

  • Revoking course access or certificates
  • Removing submitted content
  • Banning future access to the Site

You remain responsible for any fees, obligations, or actions occurring under your account prior to termination.

 

9. Disclaimer of Warranties

CoatingsAcademy.ca is provided “as is” and “as available.”

We do not guarantee that:

  • Course content will always remain available or unchanged
  • External integrations or third‑party tools will function without disruption

To the maximum extent permitted by law, CCA disclaims all warranties, express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non‑infringement
  • Accuracy or completeness of content
  • Your use of the Site is at your own risk.

 

10. Limitation of Liability

To the fullest extent permitted by law:

  • CCA will not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Site
  • CCA’s total liability will not exceed the greater of $100 CAD or the amount paid by you in the previous 12 months

This limitation applies even if remedies fail their essential purpose.

 

11. Indemnification

You agree to indemnify and hold harmless CCA, its employees, directors, partners, and affiliates from any claims, damages, or losses arising from:

  • Your misuse of the Site
  • Your violation of these Terms

Course materials are for educational purposes and should not be considered a substitute for regulatory compliance training or legal advice.

 

Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to its conflict‑of‑laws principles. Any disputes will be resolved in the courts of Ontario.
